The Legal Battle of Karen Read: Will There Be a Retrial?

The Recent Developments

The legal saga of Karen Read continues as her lawyers filed a motion this week to argue against a retrial and push to drop two of her three charges. This comes on the heels of the sale of her home by Read, which has garnered minimal interest due to the ongoing case. Meanwhile, a status hearing has been scheduled for next Monday in Dedham, Massachusetts to learn if there will be a second Read murder trial.

The Defense’s Motion

In a 10-page document filed on Tuesday, Read’s lawyers asked the court to dismiss the second-degree murder and leaving the scene of a crash charges against her. The basis of this motion is the revelation that four of the twelve jurors had come forward and claimed that during deliberations, the entire jury agreed that Read was not guilty of either charge.

The Hearing and Jury’s Verdict

Read’s defense team is now calling for either the dismissal of charges or a hearing to question the jury about what happened. The defense finds it very unusual that a jury would come to a verdict, and nobody would know, and only after the jury was dismissed would they find out. Criminal defense legal expert Peter Elikann believes that if the jury truly came to a verdict, it should be respected.

The Defense’s Claims

The defense is claiming that they were “given no opportunity to be heard” before the judge presiding over the case declared a mistrial. They believe that this is the latest attempt to stop the second Read murder trial, which the prosecution is planning to re-try.

The Sale of Karen Read’s Home

Meanwhile, Read’s four-bedroom, three-bathroom, 2, 500 square-foot Mansfield home is now up for sale for just under a million dollars. Her realtor told NBC10 Boston that they are screening prospective buyers and won’t be doing open houses due to the interest in her case.

The Future of the Case

Although there is no clear indication of what the future holds for Karen Read, these recent developments suggest that the defense is doing everything possible to prevent a retrial. As to whether or not they will be successful, only time will tell.
